Buyer's Acknowledgement, Disclaimer and Consent

I hereby agree that the information above is correct and a Contract will be procured in the name/s of the purchasing entity noted above. 


I understand the Lot/Unit choice selected in order of preference and availability will be allocated on a first in first served basis; and I agree to sign and return the sale and purchase agreement within 48 hours of receiving confirmation of the allocation or the lot/unit will be placed back on the market.


Positive Real Estate (NZ) Ltd does not provide advice on investments. All interested parties must rely on their own research before making any investment decision and should seek independent advice from a qualified financial planner or similar professional.


As part of your due diligence it is also the Buyer's responsibility to obtain independent legal and/or technical advice


The Purchaser must adhere to the terms, conditions and subject clauses contained within the Sale and Purchase Agreement. Whilst Positive Real Estate Ltd has made a number of assumptions when preparing the Property Information Report and analysis, these assumptions should be independently assessed by the Buyer/s as part of their Due Diligence.


I consent to receiving the Sale and Purchase Agreement Disclosures by way of electronic transmission such as but not limited to DocuSign.

When you provide  Positive Real Estate (NZ) Limited with your personal information via the online Expression of Interest submission we seek your consent to disclose the information for the purposes of procuring a Contract for Sale.

Any personal information collected by Positive Real Estate will be handled in accordance with the provisions of the Privacy Act 2020. 

The collection and disclosure of personal information to any third party will be for the primary purpose of procurement and transaction of your property purchase Contract and in strict adherence and within the framework and protection of the New Zealand Information Privacy Principles (NZ IPPs).

We are committed to securing your data and keeping it confidential and we take appropriate steps to protect your personal information held by us from misuse, interference and/or unauthorised access or distribution. 

This includes during storage, collection, processing, transfer and destruction of the information.
